A report into President Joe Biden's classified documents probe is expected to be published this week, according to a legal expert.

President Biden is under investigation by Special Counsel Robert Hur after Obama-era classified documents were discovered at his home in Delaware and a private office of his at the Penn Biden Center in Washington D.C.

The documents were found by aides between November 2022 and January 2023 and were turned over to the National Archives and Records Administration, where records are sent when an administration ends. U.S. Attorney General Merrick Garland appointed Hur to investigate in January 2023.

A potential release of Hur's investigation has been reported by Joyce Vance, a lawyer, professor and former U.S. Attorney for the Northern District of Alabama. In her newsletter titled "Civil Discourse with Joyce Vance" on February 4, she wrote that the final report could be issued "as early as this week". Newsweek has contacted the White House and the Department of Justice for comment via email and web form respectively.

What Will Be in the Report?

What the report will determine is unknown, but Vance said that Biden is unlikely to face any criminal charges relating to the storing of the documents, which included documents labeled "top secret" and U.S. intelligence memos. Axios recently reported that Biden's aides are concerned the report could include "embarrassing" details about how the documents were stored, which could include photos.

Who is Robert Hur?

Hur was appointed to the role of U.S. Attorney in 2017 after being nominated by Trump. He served in the role until his resignation in 2021.

"I will conduct the assigned investigation with fair, impartial and dispassionate judgment. I intend to follow the facts swiftly and thoroughly, without fear or favor, and will honor the trust placed in me to perform this service," Hur said in a statement.

Hur also served as an assistant US attorney in Maryland before working as the principal associate deputy attorney general with the DOJ.

What Has Biden Said?

Prior to Hur's appointment, Biden said: "People know I take classified documents and classified material seriously. I also said we're cooperating fully and completely with the Justice Department's review."

Vance said Biden's likely opponent in the upcoming November presidential election, Donald Trump, would possibly seek to "jump on this and hound Biden while claiming he, himself, is the victim of political persecution."

Trump was indicted on 37 federal counts after a raid on his Mar-a-Lago home in August 2022 which found classified documents inside the property. He has pleaded not guilty to all charges against him. The case is currently set to go to trial in May this year.
